In line with the Royal Law No. 36 of 2014, on criminalizing and combating the smuggling of the subsidized oil by-products, Bahrain National Oil and Gas Authority (NOGA) announced the preparation of the executive regulations drafts of the law, in preparation for submission to the competent authorities for approval.
The law comes to complement the NOGA regulatory and legislative role. Law 36 provides a legislative cover to criminalize the smuggling or attempting the smuggling of subsidized oil by-products. Law 36 also provides a legislative item for the public prosecutor to apply in the crimes of smuggling of subsidized oil by-products, which is considered theft of public money that requires inflecting legal punishment.
Therefore, crime perpetrators shall be punished by imprisonment of not less than six months nor more than three years, and a fine of not less than the value of the goods before it was subsidized nor more than threefold its value, or one of the two punishments. And the confiscation of the unlicensed smuggled or exported substances.
